Third-party Claims In Rear-impact Accident Cases

ARCCA was recently asked to investigate a case where a tractor trailer hit a pick-up truck from behind in a chain reaction pile-up on an interstate, killing the driver of the pick-up truck.  We were working for the insurer of the tractor trailer.  After an extensive investigation, our experts’ final findings in this case showed that the pick-up truck driver’s fatal injuries were caused by the failure of his seatback.  A third-party claim was filed and the case was subsequently settled satisfactorily.
