ARCCA was retained on a case where the vehicle’s driver suffered severe burns on his legs. Our engineer investigated the design of the heating unit and found that it allowed excessive heat. The manufacturer was aware of this problem and assumed that if excessive heat entered the occupant compartment, the passengers would feel the heat and turn it down. In this instance, the plaintiff had limited sensation in his legs and was unable to feel the increased heat. Our engineer determined the mechanism that allowed the plaintiff to be burned in this instance was the same mechanism as known by the manufacturer.
